PRELIMINARY PROPOSAL ON THE ISSUE OF ASSISTANCE IN OBTAINING A TEMPORARY RESIDENCE PERMIT FOR THE PURPOSE OF OBTAINING EDUCATION FOR FOREIGN STUDENTS ON THE TERRITORY OF THE RUSSIAN FEDERATION IN MOSCOW

From January 01, 2023, Federal Law No. 357-FZ of 07/14/2022 "On Amendments to the Federal Law "On the Legal Status of Foreign Citizens in the Russian Federation" and Certain Legislative Acts of the Russian Federation" regarding the issuance of a temporary residence permit for the Purpose of obtaining education for foreign students comes into force.

TEMPORARY RESIDENCE PERMIT FOR THE PURPOSE OF EDUCATION

Foreign students studying full time at Russian state universities or scientific organizations under programs that have state accreditation will be able to obtain a temporary residence permit for the purpose of obtaining education (hereinafter referred to as RVP POE) for the purpose of education.

Foreign full time students studying bachelor's degree, specialty, master's degree, internship, assistant internship, training of scientific or scientific-pedagogical personnel in postgraduate (adjunct) can apply for the RVP POE.

Particularities:

The RPA POE is issued for the period of study + for another 180 calendar days, after the day of the end of the study period.
The RVP POE can be issued only in the region of the Russian Federation where the foreign student is studying and only on the territory of the Russian Federation.
The application processing period for receiving the RVP POE is two months.
For registration of the RVP PEO, the documents confirming enrollment for full-time study at a state university, or a scientific organization must be submitted.
Within 30 calendar days from the date of receipt of the act of expulsion due to transfer, a foreign student is obliged to submit to the territorial authority of the Ministry of Internal Affairs of the Russian Federation, which issued the RVP PEO, a document confirming his enrollment for full-time study in another state university or scientific organization.
International students are not required to submit annual notices confirming residence and income.
In addition to the general grounds applied for refusal to issue or cancelation of the issued RVP, RVP PEO will be canceled in following cases:
transition to part-time education.
early termination of studies.
violation of the 30-day deadline for submitting to the territorial authority of the Ministry of Internal Affairs of the Russian Federation a document confirming admission to a full-time study at another state university or scientific organization during transfer of a student.

ADVANTAGES

If there is the RVP PEO, a foreign student can permanently reside in Russia, as well as leave Russia and enter back, on the basis of a multiple-entry temporary resident visa issued for the duration of the RVP PEO or visa-free regime, if this is provided by an international agreement (at the moment, visa is not required for citizens of Bosnia and Herzegovina, Germany, Italy, Macedonia, Mongolia, Poland, Serbia, Turkey, Croatia and Montenegro temporarily residing in the Russian Federation,)
In the case of own housing, a temporarily residing foreign citizen can register at the place of residence for the entire period of validity of the RVP PEO. The migration registration procedure is applied in case of absence of a place of residence or in case of departure outside the region of receipt of the RVP.
A temporary resident foreign citizen may register an Individual Entrepreneurship and engage in entrepreneurial activity.
A temporary resident foreign citizen has the right for social support, including free medical care in state medical organizations.
Foreign students who have received RVP PEO have the opportunity to obtain a residence permit in a simplistic way for 3 years after graduation

DISADVANTAGES

A temporary resident foreign student can live and work only in the region where the RVP PEO was issued.
The total period of stay of a temporarily residing foreign citizen outside of Russia without a valid reason may not exceed 6 months during a calendar year.

Payment of the state fee, the cost of notary services during the certification of a Power of Attorney for escort to the Department of Internal Affairs of the Ministry of Internal Affairs of Russia in Moscow and other related costs are not included in the cost of services and are paid by the Client additionally.
